Val-des-Monts fence by-laws

The short answer

Height is measured from the average ground level where the fence is built, erected or planted.

One detail that matters and that few people anticipate: those three limits are tied to the front, side and rear margins, and the depth of those margins is set zone by zone in the specifications grid. To know where your front margin ends you need your zone's grid. We check it during the visit.

On a lot at the intersection of two streets, the triangle must stay clear of any obstacle taller than 75 cm, measured from street level. Each side is at least 8 m from the point where the streets intersect.

No parking space may sit inside it. A structure on a single post, or not fixed to the ground, may encroach if it is 2.7 m or more above ground.

There is a rare exception: the rule does not apply where, after inspection, a hedge inside the triangle and taller than 75 cm is found not to obstruct traffic safety.

The list applies to fences, low walls and retaining walls alike:

• Chicken wire, except for agricultural uses.
• Barbed wire, except the Industry and Agricultural groups.
• Exposed particle board, chipboard or plywood.
• Sheet metal, sheet-metal or steel panels and similar materials.
• Canvas, fabric, textiles and similar.
• Any flexible material (plastic, cardboard, paper) lacking the rigidity to ensure safety or prevent intrusion.
• Any other material not specifically intended for building fences.

One more siting rule: fences and hedges must sit at least 1.5 m from any public utility equipment.

A pool enclosure must:

• block the passage of a 10 cm sphere;
• if chain link, have mesh no wider than 30 mm (slats may widen it, without letting more than 30 mm through);
• be at least 1.2 m high;
• carry no fixing, projection or open part that would help climbing.

A hedge or shrubs cannot serve as a pool enclosure. The gate must have a passive safety device that closes and locks it automatically, placed inside in the upper part, or outside at least 1.5 m above ground.

An above-ground pool with a wall at least 1.2 m everywhere, or a demountable pool of 1.4 m or more, needs no enclosure if access is controlled. The provincial rule applies on top: see our Quebec pool fence law guide and the 30 September 2027 deadline.

Two questions come up often and we will not publish an answer until it is confirmed, because a wrong answer costs more than no answer.

• Does a fence need a permit or certificate in Val-des-Monts? The word for fence appears in neither of the two tables in the permits and certificates by-law that list the works requiring one. Yet the fee schedule in that same by-law carries a line reading « Piscine et clôture, 55 $ ». The two contradict each other. To be confirmed directly with the Municipality.
• How far from the lot line? The by-law contradicts itself here too. We will publish neither 0 m nor 1 m until it is settled.

We do not publish an in-force date, because the by-law itself gives none and we could not confirm one against a live official document. Adoption on 18 February 2025 is verified. A by-law can be amended: confirm with the Municipality before ordering, or ask us to do it.
